Terms of service
This website is intended to present the artistic work of Kariné and, where applicable, to allow the purchase of completed artworks or the initiation of commissioned artistic projects.
Access to the website, browsing, and use of the services provided imply acceptance of these Terms and Conditions, as well as the policies referenced and available on the website, including the Shipping Policy, the Refund Policy, and the Privacy Policy.
Nature of the Service and Type of Works
The website presents:
-
completed, unique artworks available for purchase;
-
commissioned artworks and artistic projects developed through a personalized creative process shared with the client.
Images and materials displayed on the website are for descriptive and illustrative purposes only.
In the case of commissioned works, they do not constitute a commitment to an identical reproduction of the final result, as each artwork arises from an original creative process.
Completed and Available Works
Completed artworks are offered as finished pieces.
Each artwork is unique and described with the utmost possible accuracy through images and information provided on the website.
Minor variations in color perception, material appearance, or dimensions may result from the characteristics of the digital device used for viewing and shall not constitute a defect.
The purchase contract is considered concluded upon order confirmation through the Shopify platform.
Commissions and Custom Projects
Requests for commissioned artworks or personalized projects do not automatically constitute a binding contract.
Kariné reserves the right to accept or decline a commission following a preliminary consultation phase.
Economic terms, production timelines, and operational details are defined and agreed upon before the start of the work.
Production Timelines
Estimated timelines provided for commissioned works or personalized projects are indicative and non-binding, as they depend on the nature of the creative process and possible intermediate consultation phases.
Payments
For completed and available artworks, payment is processed through the payment methods made available by the Shopify platform at checkout.
For commissioned artworks or personalized projects, payment terms are communicated and agreed upon in advance.
In such cases, a deposit may be required, the amount and timing of which will be defined before work begins.
The commencement of a commissioned artwork may be subject to receipt of the agreed deposit.
Once the creation process has begun, the deposit is non-refundable, in accordance with applicable law.
Intellectual Property
All artworks, images, texts, and content displayed on the website are protected by copyright.
Any reproduction, distribution, or use, even partial, of the content without prior written authorization from the artist is strictly prohibited.
Limitation of Liability
To the extent permitted by law, the artist shall not be held liable for:
-
differences between the client’s subjective expectations and the final artistic result;
-
delays not directly attributable to the artist’s activity;
-
improper or non-compliant use of the artworks by the client.
Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
For relationships with clients who do not act as consumers, the competent court shall be that of the artist’s place of residence or domicile.
For consumer clients, the jurisdiction provided by applicable consumer protection laws shall apply.
